Terms of Service
The plain-language version: use BuboSoma to run your practice, your data stays yours, we don't take a cut of what you earn, and either of us can walk away anytime. The full terms below cover the details.
1. What BuboSoma Is
BuboSoma provides scheduling, client records, payment processing, and related practice management tools. SOAP note documentation and membership management are planned features and are not currently available; their status is shown on the BuboSoma Roadmap. These tools are built specifically for massage therapy and bodywork professionals, offered on a subscription basis, prepaid/lifetime access offers, and paid add-ons.
2. Your Account
Accurate information. Keep your account information current and accurate.
Account security. You're responsible for activity under your account, including your employees and staff. Tell us promptly if you suspect unauthorized access.
Lawful use. You'll comply with applicable laws, including massage therapy licensing, client data privacy, and payment regulations. You're solely responsible for your own professional licensure and scope of practice.
Your clients. You're responsible for getting any consents required before collecting or storing client information through the Service.
Acceptable use. No unlawful content, no disrupting the Service, no unauthorized access attempts, no spam, no reverse engineering.
3. Your Data
You own it. All client records, SOAP notes, and business data you put into BuboSoma belong to you. We don't claim ownership.
How we use it. Only to provide, maintain, and improve the Service for you, and for billing and support. We don't sell your data. Aggregated or de-identified data we might use for product improvement will never identify you or your clients.
HIPAA. BuboSoma is built with HIPAA-aware design practices.
Security. We maintain reasonable safeguards to protect your data. No system is perfectly secure, and we can't guarantee absolute security.
4. Fees & Billing
-
Each legal business may use one 14-day trial. No payment card is required. Trial accounts may have reasonable limits on email/SMS sends and storage, rather than the full volume included with a paid tier. On day 15, choose a paid plan to keep using BuboSoma. If no plan is selected, the account pauses in read-only mode: you can view and export your data, but booking, calendar changes, payments, messages, staff actions, and all active practice-management functions are disabled. You have 90 days from the end of your trial to select a paid plan or export your data. After that period, account data may be deleted or de-identified, subject to applicable legal, regulatory, security, and backup-retention requirements.
5. Third-Party Tools
BuboSoma may integrate with third-party tools (QuickBooks, Google Calendar, Mailchimp, Zapier, Square, and similar). These are provided by third parties, aren't part of the Service, and are governed by their own terms. We're not responsible for their availability or practices.
6. Intellectual Property
Our IP. BuboSoma owns the Service, its software, design, and trademarks. You get a limited, non-exclusive right to use it for your business, not to copy, modify, or reverse engineer it.
Your content. You keep ownership of your business name, logo, and any content you upload for your booking pages. You grant us a limited license to display it as needed to run the Service for you.
7. Disclaimers
The Service is provided "as is." We disclaim implied warranties to the extent the law allows, and don't guarantee uninterrupted or error-free operation.
Important: BuboSoma is software. We don't provide massage therapy or healthcare services, and we're not responsible for the professional services you provide to your clients.
8. Limitation of Liability
To the extent the law allows, our total liability for any claim is capped at what you paid us in the twelve months before the claim arose. We're not liable for indirect, incidental, or consequential damages, including lost profits or lost data.
9. Indemnification
You agree to cover claims arising from your breach of these Terms, your violation of law, the massage therapy or related services you provide, or content you submit through the Service.
10. Termination
You can cancel anytime. We may suspend or terminate your account for uncured material breach, or immediately for security or legal risk. After termination, you can export your data for 90 days before we may delete it, except where the law requires us to retain it.
11. Massage Pathology Pro
Reference only. Massage Pathology Pro is an educational and professional reference. It is not medical advice, diagnosis, or treatment, and it does not replace your independent professional judgment, scope of practice, or referral to a qualified health care provider. Some content is under clinical review. ICD-10 and CPT references are provided for reference only and must be verified before billing.
Suggestions you send. If you send a suggestion or correction, you give BuboSoma a free, permanent, worldwide right to review, edit, use, and publish it, without payment or credit to you. We are not required to add any suggestion. Do not send client names or other identifying information, confidential information, or content you do not have the right to share.
Acceptable use. Do not use automated tools to send suggestions or searches, attempt to overload the service, or copy the library in bulk.
12. Changes to These Terms
We may update these Terms. Material changes will be communicated by email or in-app notice before they take effect. Continuing to use the Service afterward means you accept the update.
13. Dispute Resolution
Contact us first. If you have a concern or dispute, please contact us first using the contact information in these Terms. Include your name, the email address associated with your account, a description of the issue, and the outcome you are seeking. We will make a good-faith effort to resolve the matter informally within 30 days.
Small claims court or court proceedings. If we cannot resolve a dispute informally, either you or BuboSoma may bring an individual claim in small claims court if the claim qualifies. If small claims court is not available or appropriate, either party may bring the claim in a court of competent jurisdiction.
Emergency relief. Nothing in this section prevents either party from seeking urgent court relief to prevent unauthorized access, misuse of the Service, infringement of intellectual-property rights, or a security incident.
14. General Terms
Governing law. Wyoming law governs these Terms.
Entire agreement. These Terms plus our Privacy Policy make up the whole agreement between you and BuboSoma.
Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
Assignment. You can't assign these Terms without our consent. We may assign them in a merger, acquisition, or asset sale.
